The buying process in Spain is simple.It is helpfull to obtain a mortgage offer in principal before you go looking,so as to understand how much you can borrow and how much the costs will be. Once you find your dream home, the real estate agent will normally ask you for a holding deposit, this is normal practice in Spain, but it is wise to use your Lawyer to handle this and put a clause in your reservation document, "subject to mortgage" to protect your money. The property is then surveyed and the lawyer will check to see if the property is suitable, ie, does it have an existing mortgage that will need cancelling, are the correct licences available, which could be the first occupational licence, if the property shows the correct area of sq meters and if it doesnt, can the excess area be made legal. These are things that are part of the conveyencing process. Your lawyer will draught a purchase contract which will be binding and will show the payment structure, what you are buying, the price etc, very similar to the UK. A date is made to go to a Notary, who will check everything is in order with the purchase annd that the vendor and purchaser are in agreement with the sale. A translator will be available for those who dont speek Spanish. Once the escritura is signed you will then receive the keys of your home. |
